Terms of sale
Provisional version of 26 October 2026 — information to be completed
To be completed: exact legal name, legal form, paid-in capital, SIREN and registration register, VAT number or applicable status, public telephone number, operational payment methods and the consumer mediator actually appointed. Confirm deadlines and the social content schedule before opening orders. Replace all bracketed fields.
1. Seller, contact and scope
These terms of sale concern services sold directly by [exact legal name], trading as Nubia Esthetic, [legal form and capital to be confirmed], with its registered office at 888 route de la Caille, 74350 Allonzier-la-Caille, France; [SIREN, register and VAT number where applicable]; telephone: [to be completed]; email:contact@nubiaesthetic.com.
They apply to listings, subscriptions and presentation or visibility services expressly ordered from Nubia. Treatments, products or training purchased directly from a listed professional or supplier are not sold by Nubia and are governed by the contract with that third party.
Customers are distinguished according to whether they act for business purposes or as consumers. Mandatory provisions applicable to consumers and to professionals entitled to particular protection prevail. Website use is also governed by the terms of use.

Suppliers
Source includes essential information, logo, category, country and website link. Essence adds a detailed listing, product gallery, PDF catalogue, distributed brands, delivery areas and trade terms, and a quote request facility when operational. Lumière adds rotating featured placement and the social content stated in the accepted offer. The current supplier Lumière grid provides two posts and four stories per year. No partner code or commission on supplier sales is included.
Individuals and future services
Browsing the directory remains free, without a mandatory account. Nubia Premium is currently a proposed offer: its benefits and opening date must be confirmed before any sale. The displayed price of €5.90 per month or €59 per year does not alone constitute a subscription or commitment to provide services not yet open.
These terms do not open sales of Nubia Shop products, training or event tickets not yet marketed. Appropriate terms for each activity must be supplied before it opens.

4. Prices, currency and taxes
Prices include taxes and are shown in the stated currency. The total due, applicable taxes and any fees are communicated before the order. Invoices state the tax treatment actually applicable; no VAT exemption is presumed.

The monthly equivalent of an annual price is for comparison only and does not constitute annual payment by instalments. Prices outside the euro area, particularly in Swiss francs, are set by market and provided in a dedicated price list or proposal; they are not automatic conversions of these amounts.
Applicable prices are those clearly presented and accepted when ordering. A price change does not retrospectively affect a period already ordered and paid for.
5. Enquiries, orders and evidence of agreement
Contact or information buttons and submitting a listing do not constitute a paid order. Nubia reviews the request and sends a summary stating the offer, services, required information, total price and currency, payment methods, duration, start date, performance schedule and ending or renewal terms.
Customers can check and correct information before committing. The order is concluded after their express agreement to the summary and terms of sale, followed by confirmation from Nubia on a durable medium, including email. Any online payment journey must unambiguously identify the obligation to pay. Customers receive and can retain a copy of the terms and order summary.
No additional service or option is charged without express agreement. Manifestly unlawful requests or requests that cannot be fulfilled are refused with reasons; any amounts received for an unaccepted order are refunded.
6. Payment and invoicing
[Before publication, confirm operational payment methods, payment provider and due-date rules.] The order summary and invoice state the due date. Annual payment is made in one instalment for the ordered twelve-month period. Customers must never email their full bank card details to Nubia.
Recurring charges require appropriate authorisation and advance information about payment dates. No payment method is reused to turn a free offer into a paid one without an express subscription. No early-payment discount is given unless otherwise agreed in writing.
Business customers subject to French law:for late payment of an amount due that is not seriously disputed, penalties accrue from the day after the invoice due date without prior reminder, at the European Central Bank refinancing rate plus ten percentage points, under Article L. 441-10 of the French Commercial Code. The fixed recovery fee is €40; additional costs may be requested with evidence under legal conditions. These rules do not apply to consumers.
7. Activation and performance
The listing publication and content production dates or deadlines are expressly communicated before the customer agrees. Timelines depend on necessary materials identified at the outset; Nubia informs the customer within a reasonable time of missing items or difficulties and agrees a revised schedule where needed. No indefinite performance deadline may be imposed.
Listings require approval before publication. Social content and interviews require an appointment, usable materials and prior approval. Customers remain free to refuse social media communication; contractual treatment of refused content is agreed with them, without unilateral substitution.
Featured placements are shared with other listed members according to criteria and timing communicated before ordering. They do not guarantee permanent first position, geographic exclusivity, appointment numbers or revenue. Nubia remains obliged to provide the visibility services promised.
8. Duration, renewal and ending
Each order specifies whether it covers one or twelve months and its start and end dates. Tacit renewal cannot be inferred solely from monthly or annual payment.Without an expressly accepted renewal clause, the contract ends on the agreed date and renewal requires a new order.
Where renewal is offered, customers receive advance information about its frequency, price and non-renewal procedure. Legally required information and cancellation options are respected, including for consumers and non-professionals covered by Articles L. 215-1 onwards of the French Consumer Code.
Customers may request non-renewal at contact@nubiaesthetic.com without giving a reason. The request is confirmed with its effective date. Where applicable, an online cancellation facility must be accessible and tested before subscriptions open; an email link alone does not replace it.
A request to stop during a period does not by itself cancel amounts due for services contractually performed. Withdrawal, conformity and termination rights for non-performance remain applicable. On expiry, a listing may return to Source if requested and listing conditions remain satisfied.
9. Withdrawal where this right applies
Consumers entering a distance service contract have fourteen days from conclusion to withdraw without giving a reason. They may send the form below or any unambiguous statement to contact@nubiaesthetic.com or by post to the seller’s registered office. Sending before the deadline is sufficient. Rules extending the period where information is missing remain applicable.
Amounts received are refunded within fourteen days of notification of withdrawal, using the same payment method unless the customer expressly agrees to another fee-free method. Where the customer expressly requested early performance and received required information, only the proportion actually performed may be payable under legal conditions. Opening an account or website access alone does not waive withdrawal rights.
Professionals also benefit from Article L. 221-3 protections where its conditions are met: an off-premises contract, subject matter outside their main activity and no more than five employees. Outside these circumstances or a specific agreement, there is no general withdrawal right between businesses.
[Before any online consumer sale: install and test the withdrawal facility required by Article L. 221-21, its confirmation button and dated durable acknowledgement; state its actual location here. These terms do not declare that facility operational.]

10. Service not supplied, non-conforming or interrupted
For delay, non-supply or breach, customers contact Nubia to request performance or correction. They retain legal remedies, including withholding performance, price reduction or contract termination where the relevant conditions are met. Refundable unperformed services are not retained as a fixed penalty.
Guarantees for digital content and services — consumers
Where a service falls under the digital content and services regime, Articles L. 224-25-12 onwards of the French Consumer Code apply: Nubia is liable for conformity defects throughout a continuous supply contract; for a one-off supply, for defects appearing within two years of supply. Conformity must be restored free of charge, without undue delay or major inconvenience. Subject to legal conditions, consumers may obtain a price reduction or termination; related refunds are made within statutory deadlines. Necessary updates, including security updates, are supplied for the required period. Legally due damages remain available.
[Before opening Nubia Premium: specify actual features and compatibility, update duration, guarantor identity and telephone number, and insert the complete mandatory statutory notice corresponding to the supply model chosen. This working summary does not replace that notice.]
Significant interruptions attributable to Nubia receive an appropriate response: restoration, extension or refund according to the contract and legal rights. No general exclusion of liability or refunds is imposed on customers.
11. Parties’ obligations and content
Customers provide accurate information and lawful content, hold necessary rights and comply with their professional rules, including healthcare ethics and communication rules. Nubia may not impose communication incompatible with those rules. Permissions for images and social content are defined in the terms of use and collected separately where necessary.
Suspension for breach must be reasoned and proportionate, with an opportunity to correct except in emergencies or where legally required. It does not allow Nubia automatically to retain payment for undelivered services or deprive customers of rights. In force majeure as defined by Article 1218 of the French Civil Code, the parties inform each other and apply legal consequences for performance, duration and, where needed, termination.
12. Complaints, mediation and jurisdiction
Complaints are sent to contact@nubiaesthetic.com or the seller’s registered office with the order reference and relevant facts. Do not attach medical records. Nubia acknowledges receipt and provides a response or progress update within a reasonable time.
After a prior written complaint remains unresolved, consumers may refer the matter free of charge to Nubia’s appointed mediator, subject to applicable admissibility conditions:[name of the mediator actually appointed, postal address and website to be completed before consumer sales]. They retain the right to bring proceedings before the competent court.
French law applies subject to mandatory customer protections, including those of their country of residence where applicable. Competent courts are determined by law; consumers are not subject to exclusive jurisdiction. Consumer mediation does not apply to business-to-business disputes.
13. Data, retention and changes
Theprivacy policydescribes processing needed for orders, invoicing and services. Newsletter signup is optional and separate. Contractual correspondence and confirmations are retained under applicable obligations and may be requested at contact@nubiaesthetic.com.
The version applying to an order is the one supplied before acceptance. Later changes do not retrospectively alter ongoing periods without agreement or a legal provision. Invalidity of one clause does not affect other valid provisions.
